Commercial Dispute Resolution and Litigation - Examples of Peter Waller's work include:
- Being the lead lawyer for a V8 Supercar Team in a Supreme Court action which involved complex legal issues such as declarations as to the validity of contracts, injunctions, damages, the Trade Practices Act, and the Corporations Act. The action was on the Supervised Case List and involved 23 defendant parties.
- Representing company directors in actions by the ATO involving directors’ obligations for unpaid company taxes and penalties, and negotiating commercial outcomes.
- Acting for publicly listed financial services companies to recover loans and secured property, professional indemnity claims against valuers for negligence, and liquidations and bankruptcies.
- Representing the supermarket owner on Hamilton Island in the Supreme Court in relation to a dispute over interests in local government land and the real property tenure of the licence agreement.
- Managing the successful defence of an action by Louis Vuitton in the Federal Court involving complex trademark liability issues.
Property Litigation and Dispute Resolution – Examples of our Principal’s work include:
- Managing a complex action in the Planning and Environment Court involving declarations defining and restricting significant development on commercial land which had been rezoned under a rezoning agreement and a ministerial rezoning.
- Acting for owners of substantial commercial properties to successfully terminate commercial leases, recover possession of the properties, and recover unpaid monies.
- Acting for mortgagees to recover possession of large parcels land and secured property.
- Managing an action in the Supreme Court for a landowner of a large parcel of development land involving contract construction and Trade Practices.
